1. About the Platform
Nomadly Marketplace is an independent digital marketplace platform created and owned by Reena Aquino ("the Creator"). The platform operates at tarabespoketravels.com and connects travellers, digital nomads, students and expats ("Citizens") with vetted local service providers ("Partners").
Nomadly Marketplace is not affiliated with, related to, or in partnership with Nomadly Bespoke Travels or n0madly.com. It is independently owned and operated.
2. Eligibility
You must be at least 18 years of age to use this platform. By registering, you confirm that all information you provide is accurate and that you have the legal capacity to enter into a binding agreement.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorised use of your account
- We reserve the right to suspend or terminate accounts that violate these terms
4. Bookings & Payments
Nomadly Marketplace facilitates bookings between Citizens and Partners. When you make a booking:
- A binding agreement is formed between you and the Partner upon confirmation
- Payments are processed securely via Stripe
- Nomadly Marketplace charges a service fee which is included in the displayed price
- Cancellation and refund terms are set per Partner and disclosed before booking
5. Partner Obligations
Partners listed on Nomadly Marketplace agree to:
- Provide accurate and truthful information about their services
- Honour confirmed bookings in accordance with their stated terms
- Maintain appropriate licences and insurance for their services
- Respond to booking requests within the agreed timeframe
- Treat all Citizens with professionalism and respect
6. Prohibited Conduct
You must not:
- Use the platform for any unlawful purpose
- Copy, reproduce, reverse-engineer, or distribute any part of the platform
- Attempt to gain unauthorised access to any part of the platform or its systems
- Post false, misleading, or fraudulent content
- Harass, threaten, or harm other users or partners
- Circumvent the platform to make direct payments to Partners outside of Nomadly Marketplace
7. Intellectual Property
All content, design, code, features, branding, and intellectual property of Nomadly Marketplace are the exclusive copyright of the Creator, Reena Aquino. All rights reserved.
You may not reproduce, copy, distribute, modify, create derivative works from, or commercially exploit any part of this platform without express written permission from the Creator.
Violations will be prosecuted to the fullest extent of the law.
8. Disclaimer of Warranties
Nomadly Marketplace acts as a marketplace facilitator only. We do not provide the services listed by Partners. We make no warranties regarding the quality, safety, legality, or accuracy of Partner services. Your use of Partner services is at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, Nomadly Marketplace and its Creator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, or personal injury arising from Partner services.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malta and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malta.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the platform constitutes acceptance of the revised Terms.
